Thank you for your participation with Blakely Clothing Ltd for this event. Please ensure that you read the following terms and

conditions laid out in the below statement. By signing this form or participating in

1. Risk and Liability.

You acknowledge that any participation in and Blakely Clothing event, can be inherently dangerous and that you may be exposed to certain risks during the event including, but not excluding overexertion, equipment failure, dehydration, serious accidents, and risks associated with the course and adverse weather conditions. These risks can take place and they may result in you being personally injured or killed, your property being damaged, or the event being cancelled.

By entering the event or participating in any capacity, you agree that:

• You have read and understood the risks that can be associated with participating in any Blakely Clothing event and this warning.
• You accept and assume the inherent risks involved with your participation in this event.
• At any Blakely Clothing event, you are fully responsible for your own personal health and safety throughout the activation at all times and the security of your own personal and valuable possessions. You hereby agree that Blakely Clothing are not responsible or liable for your health and safety or the repair or replacement of any personal possessions should they be lost, stolen or damaged in anyway.
• You acknowledge that where you are a consumer of recreational services, as defined by the competition and Consumer Act 2010 (Cth) or any relevant law, certain terms and rights usually implied into a contract for the supply of goods or services may be excluded. You acknowledge that these implied terms and rights and any liability of the event flowing from them, are expressly excluded to the extent permitted by law. To the extent of any liability result from, the liability of Blakely Clothing Ltd, at its discretion, be limited in the case of goods, to the replacement, repair, or payment of the cost of replacing the goods and in the case of services, the entry fee relating to the Event.

2. Release and Indemnity.

In consideration of any Blakely Clothing event, accepting your participation in any event if activity for these activations.

You, on behalf of yourself, your heirs, executors, and administrators, to the extent permitted by law.

3. Privacy.

• I am taking part in the Blakely Event entirely and solely at my own risk.
• I accept that Blakely Clothing Ltd, shall not be liable or responsible for anything related to or arising out of my participation from this event. This includes but not limited to injury, or damage to myself, or any third party property.
• I am in good health, physically fit and I am not aware of any physical or psychological reasons why I cannot partake in this event.
• I acknowledge and agree that any participation in this event carries an inherent risk of potential accident or injury.
• By signing this waiver and realise I am agreeing to everything outlined in this document for all participation in the events going forward.
• Id like to be signed up to the Blakely Clothing email list to get updates, special access to promotions and more.
• I am allowing Blakely Clothing Ltd, to the usage rights of all content captures at the event to be used on socials for a period that does not expire. (Please notify photographer or event organiser if you do not wish to be photographed).
• I am 18 years of age or older, competent to sign this waiver and release.

• I have no pre-existing injuries, pain, or have undergone recent surgical procedures of any kind.
• I am not pregnant or have given birth recently.
• Respiratory, heart conditions, or high blood pressure.
• You will notify the instructor immediately if you experience any discomfort or pain throughout the class and cease participation.

4. Photography & Marketing Consent

By attending the Event, you consent to being photographed and recorded.
Images and footage may be used for promotional, marketing, and social media purposes by Blakely Clothing without compensation.

I consent to being signed up to Blakely email and SMS marketing to get updates, special access to promotions and more. We may also contact you regarding the performance of the event and for any feedback you may have.

You consent to the event organisers using your name, image, video, likeness, voice, any statement, at any event at any time, to promote an activation or event for Blakely for any future, similar events by any forms of media. By acknowledging these terms, you hereby agree to the above statement.

I am allowing Blakely, the usage rights of all content captured at the event to be used on socials for a period that does not expire. (Please notify photographer or event organiser if you do not wish to be photographed).

5. Data Sharing

I hereby acknowledge and consent to the sharing of my personal data to Blakely Clothing Ltd and any partner brands, for the purposes of improving service delivery, personalising my user experience, and providing tailored offers and communications.

I understand that this data may include, but is not limited to, my name, contact information, purchase history, and browsing behaviour.

I am aware that Blakely, and its partner brands are committed to protecting my privacy and ensuring the security of my personal information in compliance with applicable privacy laws and regulations.

I retain the right to withdraw my consent at any time and acknowledge that this can be done by contacting Blakely at help@blakelyclothing.com
