Please read these Terms and Conditions (“Terms”) carefully before registering for or participating in the APEX GAMES (“Event”). By completing registration, purchasing a ticket, or attending the Event, you agree to be bound by these Terms.

1. Eligibility

Participants must be 18 years or older.
All participants must be physically fit to take part and acknowledge that participation involves physical exertion and potential risk.

2. Registration & Payment

• Registration is only confirmed once payment has been made and each athlete’s details have been filled out and submitted.
• Your team ticket is refundable up until 10 days before the live event.
• Entries are transferable up until 10 days before the live event.

3. Event Check-In & Kit Collection

All participants must check in on their competition day.
APEX kit will be available for collection at check-in and will be distributed on a first-come, first-served basis.
Participants must present proof of registration to collect their kit.

4. Risk and Liability

• 4. You acknowledge that any participation in a Blakely event, can be inherently dangerous and that you may be exposed to certain risks during the event including, but not excluding overexertion, equipment failure, dehydration, serious accidents, and risks associated with the venue, course, and adverse weather conditions. These risks can take place, and they may result in you being personally injured or killed, your property being damaged, or the event being cancelled.
• By entering the event or participating in any capacity, you agree that:
• 4.1 You have read and understood the risks that can be associated with participating in any Blakely event and this warning.
• 4.2 You accept and assume the inherent risks involved with your participation in this event.
• 4.3 You are taking part in the Blakely event entirely and solely at your own risk.
• 4.4 You are in good health, physically fit and not aware of any physical or psychological reasons why you cannot partake in this event.
• 4.5 You are 18 years of age or older, competent to sign this waiver and release.
• 4.6 You have no pre-existing injuries, pain, or have undergone recent surgical procedures of any kind.
• 4.7 You are not pregnant or have given birth recently.
• 4.8 You do not have any respiratory, heart conditions, or high blood pressure.
• 4.9 You will notify the instructor immediately if you experience any discomfort or pain throughout the class and cease participation.
• 4.10 At any Blakely event, you are always fully responsible for your own personal health and safety throughout the event and the security of your own personal and valuable possessions. You hereby agree that Blakely are not responsible or liable for your health and safety or the repair or replacement of any personal possessions should they be lost, stolen or damaged in anyway.
• 4.11 You acknowledge that where you are a consumer of recreational services, as defined by the competition and Consumer Act 2010 or any relevant law, certain terms and rights usually implied into a contract for the supply of goods or services may be excluded. You acknowledge that these implied terms and rights and any liability of the event flowing from them, are expressly excluded to the extent permitted by law. To the extent of any liability result from, the liability of Blakely, at its discretion, be limited in the case of goods, to the replacement, repair, or payment of the cost of replacing the goods and in the case of services, the entry fee (if any) relating to the Event.

5. Release and Indemnity

• In consideration of any Blakely event, accepting your participation in any event you, on behalf of yourself, your heirs, executors, and administrators, to the extent permitted by law, agree to release and discharge Blakely (Blakely affiliates, related entities, employees, agents, representatives) from any and all claims or causes of action (known or unknown) arising out of the negligence of Blakely, whether active or passive, or any of Blakely’s affiliates, employees, agents, representatives, successors and assigns.
• This waiver and release of liability includes, without limitation, injuries which may occur as a result of (a) your use of any exercise equipment or facilities which may malfunction or break (b) improper maintenance of any exercise equipment, premises of facilities, (c) negligent instruction or supervision, including personal training (d) negligent hiring or retention of employees, and/or (e) slipping or tripping and falling whilst attending the event or while travelling to or from the event, including injuries resulting from Blakely or anyone else’s negligent inspection or maintenance of the facility or premises.

6. Conduct

APEX promotes sportsmanship and respect. Participants must:

• Treat staff, volunteers, and fellow competitors respectfully.
• Use appropriate language and behaviour throughout the Event.
• Follow all rules, instructions, and event signage.

Failure to comply may result in disqualification or removal from the venue without refund.

7. Photography & Marketing Consent

By attending the Event, you consent to being photographed and recorded.
Images and footage may be used for promotional, marketing, and social media purposes by Blakely Clothing without compensation.

I consent to being signed up to Blakely email and SMS marketing to get updates, special access to promotions and more. We may also contact you regarding the performance of the event and for any feedback you may have.

You consent to the event organisers using your name, image, video, likeness, voice, any statement, at any event at any time, to promote an activation or event for Blakely for any future, similar events by any forms of media. By acknowledging these terms, you hereby agree to the above statement.

I am allowing Blakely, the usage rights of all content captured at the event to be used on socials for a period that does not expire. (Please notify photographer or event organiser if you do not wish to be photographed).

8. Event Changes or Cancellation

• APEX reserves the right to modify, postpone, or cancel the Event due to unforeseen circumstances, including but not limited to weather, safety concerns, or government restrictions.
• In the case of full cancellation by APEX, participants may receive a partial or full refund at the organiser’s discretion.
• APEX is not responsible for any travel, accommodation, or ancillary costs incurred by participants. 

9. Liability Waiver

By registering, participants agree to release APEX, Blakely Clothing, sponsors, staff, and volunteers from any liability for injury, loss, or damage sustained during or as a result of participation.
Participants acknowledge that physical activity carries inherent risks and voluntarily assume full responsibility for their participation.

10. Personal Belongings

Participants are responsible for their own belongings. Blakely Clothing is not liable for any lost, stolen, or damaged property during the Event.

11. Data Sharing

I hereby acknowledge and consent to the sharing of my personal data to Blakely Clothing Ltd and any partner brands, for the purposes of improving service delivery, personalising my user experience, and providing tailored offers and communications.

I understand that this data may include, but is not limited to, my name, contact information, purchase history, and browsing behaviour.

I am aware that Blakely, and its partner brands are committed to protecting my privacy and ensuring the security of my personal information in compliance with applicable privacy laws and regulations.

I retain the right to withdraw my consent at any time and acknowledge that this can be done by contacting Blakely at help@blakelyclothing.com
